Indonesia is the largest labour market in Southeast Asia and one of the most actively regulated. Employment is governed by the Manpower Law as amended, with detailed rules on fixed-term contracts, outsourcing, severance and termination, and with a minimum wage set regionally rather than nationally. Foreign employment is permitted but framed as an exception that must be justified, with a requirement to develop Indonesian counterparts. Both facts shape a search from the first day.

What governs employment in Indonesia?

The Manpower Law and its implementing regulations, as amended by subsequent legislation including the job creation reforms, administered by the Ministry of Manpower. The framework covers contract types, working time, leave, social security enrolment through the BPJS schemes, and a structured approach to termination and severance.

The amendments over recent years changed several specifics materially — on fixed-term contracts, outsourcing and severance calculation among them — so an employment position taken from older guidance is a genuine risk rather than a theoretical one. The ministry's current regulations are the reference.

What is different about fixed-term contracts and outsourcing?

They are permitted within defined limits rather than at will. Fixed-term contracts are available for work that is temporary or project-based in nature, with limits on duration and renewal, and misclassifying continuing work as fixed-term can convert the arrangement into permanent employment by operation of law.

Outsourcing is similarly framed: permitted, but with requirements on the provider and on the nature of the work. For an employer this is an argument for deciding the engagement model deliberately at the start, with advice, rather than defaulting to whichever is administratively easiest.

How is foreign employment treated?

As permitted where the expertise is needed, subject to a plan approved by the Ministry of Manpower, a work permit, and the immigration permissions that follow from it. Certain positions are restricted, and employers are generally expected to pair a foreign hire with knowledge transfer to Indonesian employees.

What that means practically: a foreign hire is a documented case, not a form. The role has to be one that can be held by a foreign national, the plan has to be approved, and the timeline reflects both. Check the ministry's current requirements before committing to a start date.

What does scale change about a search?

Two things that surprise employers used to smaller markets.

  • **Volume does not mean easy.** Indonesia produces very large numbers of candidates for junior and operational roles, and comparatively few for specialist and senior ones — which makes screening the constraint at one end of the market and scarcity the constraint at the other. The same search process does not serve both.
  • **Geography is a real filter.** Jakarta is not the whole market, and the commute and cost realities inside Greater Jakarta affect who will accept which location. A role's actual office location belongs in the advertisement.

Where do searches slow?

At the point where an offer meets reality: the candidate's current notice, the negotiation about allowances that form a meaningful part of Indonesian packages, and — for foreign hires — the permit sequence. Packages here are often built from base plus a structure of allowances, so comparing two offers on base salary alone misleads candidates and employers equally.

What should candidates know?

That the written contract matters and should be read before signing, particularly the contract type, the probation terms and how allowances are treated. If you are offered a fixed-term contract for work that looks continuing, it is reasonable to ask why, and the answer tells you something about the employer.

Where should you check the current rules?

The Ministry of Manpower for the employment framework and foreign worker requirements, and BPJS for social security enrolment. Regional minimum wages are set and published locally, which is why a single national figure is not a usable planning number.
