How Hiring Works in Malaysia: Employment Act, Passes and Shared Services

Malaysia combines a codified employment framework with a large shared-services and manufacturing base. This explains what governs a hire, what the market is structurally built on, and where searches usually slow.

Hiring in Malaysia runs on a codified framework — the Employment Act, administered by the Ministry of Human Resources, with mandatory contributions to the Employees Provident Fund and the social security organisation — and on a labour market whose shape is set by two large structures: a shared-services and global-business-services sector that hires in volume for regional roles, and a manufacturing and engineering base concentrated in specific states.

What governs employment in Malaysia?

The Employment Act sets minimum terms — working hours, leave entitlements, notice, termination benefits — and has been amended over recent years, including changes to its coverage and to leave entitlements. The Ministry of Human Resources publishes the current position, and because the Act's scope and thresholds have been revised, that published position is what to rely on rather than an employment handbook from a few years ago.

Alongside it, employer contributions to the Employees Provident Fund, SOCSO and the employment insurance system are mandatory and form part of the real cost of a hire.

What is the market structurally built on?

Three concentrations, each of which hires in a distinct way.

  • **Shared services and global business services**, mainly around Kuala Lumpur and Selangor: finance and accounting, procurement, HR operations, IT support and increasingly analytics, hiring at volume for roles serving other markets. Language capability beyond Malay and English — Mandarin, Cantonese, Japanese, Korean, Thai — is a direct qualification here.
  • **Manufacturing and engineering**, concentrated in particular states including the electrical and electronics cluster in the north: process, quality, supply chain and plant leadership roles, where the candidate pool is regional within the country rather than national.
  • **Domestic corporate and financial services** in the Klang Valley, hiring for the Malaysian market itself.

A search that does not specify which of these it belongs to will produce candidates from the wrong one.

How does work authorisation work for foreign hires?

Through employment passes and related categories, with eligibility assessed against qualifications, salary level and the role, and with approvals involving the immigration authority and, depending on sector, a regulator or approving agency for the industry.

Two structural points: the employer applies and its standing matters, and some sectors have their own approval layer on top of the immigration process. Timelines therefore vary by sector as well as by pass type, which is why the current guidance from the Immigration Department and the Expatriate Services Division is the only reliable basis for a plan.

Where do searches usually slow?

Three places, consistently.

  • **Language requirements stated late.** If a shared-services role genuinely requires business-level Mandarin or Japanese, that halves the pool and changes the band. Saying it in the brief is much cheaper than discovering it at the second shortlist.
  • **Location assumptions.** Klang Valley, Penang and Johor are different candidate markets, and relocation within Malaysia is not costless to a candidate with a family.
  • **Counter-offers in volume hiring.** Where several employers hire the same profile continuously, notice periods become contested. Keeping contact through the notice period matters more than usual.

What should candidates in Malaysia know?

That two things widen your options materially: the languages you work in professionally, and your willingness to work to another market's hours where a regional role requires it. Both belong on your CV explicitly rather than being left to be discovered.

If you are considering a shared-services role, ask which market the role serves, what the working hours actually are, and what the progression path out of the process role looks like. Those three answers differentiate employers far more than the salary band does.

Where should you check the current rules?

The Ministry of Human Resources for employment terms, the Employees Provident Fund and SOCSO for contributions, and the Immigration Department and Expatriate Services Division for passes.

Our Kuala Lumpur office covers the Malaysian market. If you want to know what is actually filling in your function, ask the consultant who works it — that is a question no framework answers.
